“VISITORS TO THIS WEBSITE/APP ARE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (“TERMS”) SO PLEASE READ THE FOLLOWING TERMS CAREFULLY BEFORE CONTINUING TO USE THIS SITE”

  1. Tariffs/Charges for the plans chosen are to be paid in advance and such charges are not refundable as this is a prepaid service.

  2. No installation charges are applicable on connection.

  3. GST @ 18% is not included in the tariff/ charges and is payable over and above the plan charges.

  4. The Tariff Plans/Offers are subject to Guidelines/Directions/Orders issued by TRAI and/or DoT.

  5. The Company at any time, shall reserve the right to modify/withdraw this T&C including but limited to tariff plans and display the same on its website without notice to the customer and such posting will be deemed to have been read by the customer.

  6. Any one-time charges paid to Regional Partners at the time of installation are non-refundable.

  7. The company may extend a refund to the user only for his first payment in case of no-feasibility for building a new connection to the requested address.

  8. Interest-free security deposit to be refunded only online and not cash, after the return of assets in the same condition as at the time of receipt.

  9. The refund will be processed within 45 working days after acceptance of the Optical Network Unit (ONU).

  10. ONU is to be returned to a “person” appointed by Smartfi. It can be the local cable operator, Smartfi retail partner or any logistics company appointed by Smartfi to recover back the ONU from the customer location.

  11. Any fault in ONU is to be replaced by us within 5 working days to 48 hours from the time of raising the complaint with Refunds are to be processed to the bank account provided at the time of registration or to the bank account/wallet linked to the phone number registered with Smartfi.

  12. No other bank account is to be used for refunds. Cash and cheques are not to be used for customer refunds.

  13. The ONU/Router devices provided by Excitel in a bundled plan are offered as “Free to Use” for the duration while the customer is active as a paid user.

  14. It will remain the property of Smartfi Pvt. Ltd. at all times and the company reserves the right to take it back in case the connection is terminated, surrendered or inactive.

  15. If the “Free to Use” ONU/Router device is physically damaged or broken by the customer, the same shall be changed/replaced at customer request after payment of Rs.2000/- through device change/replaced request and that replaced/changed ONU/router will remain the property of Smartfi Pvt Ltd at all times and the company reserves the right to take it back in case the connection is terminated, surrendered or inactive.

  16. The speed committed under a plan is till the LAN port. Wi-Fi Speed is subject to the customer premise’s in-house coverage & customer premises device performance.

  17. The Company shall reserve the right to modify/withdraw any promotional campaign along with offered gratification (if any) and display the same on its website without notice to the Customer and such posting will be deemed to have been read by the Customer.

  18. The basis for the selection of winners under any promotional campaign held by Smartfi is at the Company’s sole discretion All product and company names are trademarks ™ or registered® trademarks of their respective holders.

  19. By submitting your information and/or contacting us through any medium like a phone call, social networking channels, website, etc, you agree to receive any promotional messages, or material and be contacted by Smartfi or their sub-vendors.

  20. All mentioned plans are subject to change or discontinuation without prior information. Not all the offered prices are available on renewal. Also, prices may differ at each location.

  21. The mentioned prices are on monthly basis.

  22. Prices as mentioned are exclusive of taxes.

  23. Promo plans or introductory offer plans are for a limited period and may be withdrawn without any prior information.

  24. These are not available on renewal and are one-time onboarding plans.

  25. The OTT Bundle is available on 300Mbps & 400Mbps multi-month plans only and SMartfi shall reserve every right at all times to revise/change it without assigning any reason thereof.

  26. Smartfi shall not charge for additional security deposits for the ONU in all cities/States/DOT Circle except Mumbai on specific Fiber (FTTH) plans offered by Smartfi.

  27. We shall reserve the right at all times to revise/change/cancel without assigning any reason thereof.

  28. There may be plans available for consumers facing collaterals that might have additional GST charges.

  29. Any misuse/fraudulent use/unauthorized telemarketing and commercial use of the Broadband connectivity by the subscriber, Smartfi reserves its right to discontinue the connection altogether for any set of Subscriber/s as Smartfi may deem fit.

  30. These Terms and Conditions shall constitute an agreement between Smartfi and each customer and by subscribing to the above plans, you accept the same as binding upon you.

  31. Smartfi is launching an ONU bundle on multi-month promotional plans for 200 Mbps, 300Mbps & 400Mbps, whereas the single-month 200Mbps, 300Mbps and 400Mbps plans will be available for sales on a refundable security deposit of INR 2000/-

refund & cancellation policy

  1. Security Deposit and Device Return Policy

    a. As part of the broadband service, the Customer may have been provided with a device known as an Optical Network Unit (ONU) against a refundable security deposit of Rs. 2000 (the "Security Deposit"). The Security Deposit is refundable only upon the successful return of the ONU device to the Company's designated recovery agent after the Customer discontinues the Services.

    b. The refund of the Security Deposit is subject to the following conditions:

    i. The ONU must be returned in proper working condition, subject to reasonable wear and tear.

    ii. The Customer must not have any outstanding dues payable to the Company at the time of device return.


  2. Forfeiture of Security Deposit

    a. If the Customer does not renew the broadband services or otherwise fails to maintain an active subscription for a continuous period exceeding six (6) months, the Security Deposit shall automatically stand forfeited. Upon forfeiture, the Company shall have no obligation to refund the Security Deposit to the Customer, irrespective of whether the ONU is subsequently returned

    b. Notwithstanding the forfeiture of the Security Deposit, the Company will facilitate the logistics for the return of the ONU device if the Customer wishes to return it. However, such facilitation does not entitle the Customer to any refund of the forfeited Security Deposit or any other compensation.


  3. Indemnification and Limitation of Liability

    a. By accepting these Terms and Conditions, the Customer agrees that the Company shall not be liable for any claims, demands, or disputes arising from the forfeiture of the Security Deposit due to non-renewal of services for over six (6) months.

    b. The Customer further indemnifies and holds the Company harmless against any liabilities, losses, or damages, including legal costs, arising from or related to the enforcement of this clause.

  4. Notificatiom

    The Company shall attempt to notify Customers of their account status and the impending forfeiture of the Security Deposit at least thirty (30) days prior to the expiration of the six (6)-month non-renewal period. However, failure to provide such notification shall not waive or affect the Company's rights under this clause
